Corporate and Regulatory

Our experience spans a wide range of issues and transactions, including advising on start-ups and registration of insurance and insurance broking business, drafting insurance business schemes of transfer and novations, advising on regulatory compliance issues, drafting of policy wordings, advising on innovative and new insurance products, as well as advising on novel insurance product distribution models.
Reinsurance
We have advised and acted for reinsurers in coverage disputes with cedents in arbitrations in the region, including Malaysia and Indonesia.
We have also advised reinsurers and retrocessionaires on contested issues under reinsurance and retrocession programmes due to the 2011 Thai floods as well as the 2010 riots in Bangkok, Thailand in relation to business interruption and property losses.
In Singapore, we have advised on the introduction of new insurance products in the market via facultative reinsurance and the optimal business model for foreign reinsurers to transact their business with Singapore depending on their business needs and commercial aim so as to achieve a business model that is optimal from both a legal and business perspective.
With the emergence of alternative risk transfer (ART) solutions to meet the reinsurance needs and protection gap in Asia, our Singapore office has the led the market in the first insurance-linked securities (ILS) transaction in Singapore in December 2018 and 23 subsequent ILS issuances as well as Asia’s and Singapore’s first collateralised longevity reinsurance transaction.
